1. Agreement to Terms
By accessing and using BrightWave Yacht Charter services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.
2. Description of Services
BrightWave Yacht Charter provides luxury yacht charter services in Malaysian waters, including but not limited to:
- Sunset cruises
- Day charters
- Corporate events
- Private celebrations
- Custom maritime experiences
3. Booking and Payment Terms
3.1 Reservations
All bookings are subject to availability and confirmation by BrightWave Yacht Charter. A booking is only confirmed upon receipt of payment and written confirmation from us.
3.2 Payment Schedule
- 50% deposit required to secure booking
- Remaining balance due 7 days before charter date
- Full payment required for bookings made within 7 days of charter date
3.3 Accepted Payment Methods
We accept major credit cards, bank transfers, and other payment methods as specified during booking.
4. Cancellation and Refund Policy
4.1 Guest Cancellations
- More than 14 days: Full refund minus 10% processing fee
- 7-14 days: 50% refund
- Less than 7 days: No refund
- No-show: No refund
4.2 Weather Cancellations
If we cancel due to unsafe weather conditions, guests will receive a full refund or the option to reschedule at no additional cost.
4.3 Operator Cancellations
If we cancel for reasons other than weather, guests will receive a full refund plus 10% compensation.
5. Safety and Conduct
5.1 Safety Requirements
- All guests must follow crew safety instructions
- Life jackets must be worn when required
- Swimming only when authorized by crew
- No alcohol consumption before boarding
- Medical conditions must be disclosed during booking
5.2 Prohibited Conduct
The following behaviors are strictly prohibited:
- Bringing illegal substances or weapons
- Excessive alcohol consumption
- Damage to yacht property
- Harassment of crew or other guests
- Smoking in non-designated areas
6. Age and Health Restrictions
- Minors must be accompanied by adults
- Pregnant women should consult doctors before booking
- Guests with mobility issues should inform us in advance
- Maximum guest capacity will be strictly enforced
7. Liability and Insurance
7.1 Our Liability
BrightWave Yacht Charter maintains comprehensive marine insurance. Our liability is limited to the maximum extent permitted by Malaysian law.
7.2 Guest Responsibility
Guests are responsible for:
- Personal belongings and valuables
- Any damage caused by their actions
- Following all safety instructions
- Disclosing relevant medical conditions
7.3 Travel Insurance
We strongly recommend guests obtain comprehensive travel insurance covering maritime activities.
8. Force Majeure
We are not liable for delays or cancellations due to circumstances beyond our control, including but not limited to:
- Severe weather conditions
- Government restrictions
- Natural disasters
- Technical failures
- Port authority restrictions
9. Photography and Privacy
- We may take photographs/videos for marketing purposes
- Guests consent to use of their likeness unless specifically requested otherwise
- Professional photography services available upon request
- Drone usage requires prior approval
10. Intellectual Property
All content on our website, including text, graphics, logos, and images, is the property of BrightWave Yacht Charter and protected by copyright laws.
11. Dispute Resolution
Any disputes arising from these terms or our services will be resolved through:
- First, good faith negotiation
- Then, mediation in Langkawi, Malaysia
- Finally, binding arbitration under Malaysian law
12. Governing Law
These Terms of Service are governed by the laws of Malaysia. Any legal proceedings must be conducted in Malaysian courts.
13. Modifications to Terms
We reserve the right to modify these terms at any time. Changes will be posted on our website with an updated effective date. Continued use of our services constitutes acceptance of modified terms.
14. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
